1. Acceptance of the General Conditions of Sale:

These General Conditions of Sale contractually govern the commercial relations between IZEULY and the customer of the IZEULY.com site.

The customer declares to have taken note of the following provisions before ordering products. By choosing to purchase products on izeuly.com, the customer expressly accepts the terms set out below.

In the event of a contradiction between these general conditions of sale and any other document appearing on the site, including quality charter or equivalent document, these general conditions prevail.

2. Price

The prices displayed on the izeuly.com site are expressed in Euros, all taxes included, and this excluding shipping costs. Transactions are denominated in Euros.

The price indicated in the summary of your order is the final price. This price includes the total price of the order with the detail of each product and the shipping costs.

IZEULY reserves the right to modify the offer published on the izeuly.com site at any time in terms of products and prices. But the products will be invoiced on the basis of the rates in effect at the time of the ordering, subject to their availability.

In the event of a manifest error in the price, linked to an entry error, Izeuly reserves the right to cancel the sale. An arrangement will then be offered to the customer.

Our sales are concluded with retention of title. The products remain the property of IZEULY until full receipt of the price.

3. Order

The customer can order online at izeuly.com.

By Internet, when you click on the "Confirm order" button after the ordering process, you declare that you fully and unreservedly accept all of these General Terms and Conditions of Sale.

The data recorded by IZEULY constitute proof of all transactions between IZEULY and its customers. The data recorded by the payment system constitutes proof of financial transactions.

IZEULY confirms to the customer that their order has been taken into account by e-mail to the address indicated by the customer.

In the context of payment by Credit Card, the sale is considered concluded only after acceptance of payment by SP +, the secure payment system of Caisse CIC and confirmation of the order by IZEULY. .

IZEULY reserves the right to refuse or cancel any new order from a customer with whom a dispute exists. In addition, in the event of a concern related to the processing of the order, IZEULY will contact the customer directly at the coordinates indicated by the latter, in order to inform him and to offer him a solution.

When placing an order, the customer provides under his sole responsibility the following information:

4. Products

The products offered comply with current French legislation. They are produced and marketed by recognized manufacturers, under their own responsibility.

IZEULY has total independence in the selection of the products offered.

IZEULY reserves the right at any time and without notice to add or remove products from its catalog.

5. Product availability

Our product offers are offered within the limits of available stocks.

In this context, indications on the availability of products are provided to you at the time of placing your order. Errors or exceptional modifications are beyond our control and IZEULY cannot be held responsible for them.

In the context of an order for a product: an unavailability of this item results in the sending of an e-mail warning the customer of the out of stock and of the replenishment time.

In the context of an order made up of several articles: an unavailability on one of the ordered articles results in the sending of an e-mail warning the customer of the out of stock and of the replenishment period concerning the missing article.

IZEULY then reserves the right to split the delivery. The additional shipping costs that may be caused by a split delivery will be borne by izeuly.

6. Zone, delivery time and prices

a- Delivery area

Delivery is limited to the following areas:

• Metropolitan France, DOM-TOM and Corsica

• Belgium, Switzerland, Luxembourg, Monaco, Andorra, Germany, Italy, Spain, Austria, Portugal

• Other countries or territories are excluded from the delivery area.

b- Preparation of the order

Between ordering and shipping, the preparation of the package requires a period of 12 to 48 hours depending on the time of receipt of the order for products stored at Izeuly, and up to 10 working days for products stored at suppliers.

Orders are not shipped or released to the customer until full payment has been received.

c- Delivery time

Standard delivery times for mainland France are 48 hours * after delivery of the package to the courier company. However, you have the option of selecting express delivery (24 hours *) at an additional cost.

For Corsica, DOM-TOM and abroad, the deadline is 5 to 8 working days *

On the izeuly.com site, an indication of the delivery time appears on each product sheet.

In order to describe as precisely as possible the total time between order and delivery (order preparation + delivery time), the following conventions are used on the site:

• product in stock at IZEULY: indicated timeframe from 2 to 5 days

• product in stock at a supplier: timeframe indicated from one week to 15 days

These times are for mainland France. For other areas, the differential corresponding to the delivery time difference announced by the carrier should be added.

Izeuly undertakes to exercise diligence in preparing and sending packages.

The customer has the option of requesting delivery to a parcel relay near the address indicated (except Lyon and Villeurbanne), in the “comments” area of the order form. In this case, the carrier will not deliver the address indicated but will choose the closest parcel relay, and will then notify the customer of the address at which he can collect the parcel.

ii - Timetable

Packages are delivered between 8:30 a.m. and 6:30 p.m. Monday to Friday.

Express delivery (24 hours) before 1:00 p.m. is possible from Monday to Saturday (at an additional cost).

iv - Receipt of the package

The customer is required to check the condition of the package on delivery. In case of missing or damaged, the customer must make reservations with the carrier at the time of delivery, or the representative of the post office or parcel relay if applicable. These reservations are to be entered on the Delivery Note. It is therefore advisable not to take leave before having opened and checked the contents of the package.

Then contact us at contact@izeuly.com specifying your contact details, the order number and the nature of the problem, in order to obtain a new delivery.

In the event of the customer's repeated absence during delivery or of non-withdrawal by the customer of the packages left available at the post office, or at the parcel relay, the possible costs of returning the products to Izeuly and reshipping the order are on client fee.

A possible delay in delivery compared to the deadlines indicated in these general conditions does not give right to damages from IZEULY.

Izeuly is released from its obligation to deliver in the event of force majeure such as war, riot, fire, strike, accident, natural disaster, impossibility of supply from a supplier.

e- Delivery rates

The cost of delivery to be borne by the customer may vary depending on the geographical area, the delivery time and time slots, as well as the weight or value of the items ordered.

The costs are then a minimum of 40 € TTC outside mainland France, and 60 € TTC for TOM.

At the time of the order, it is the customer who selects the shipping costs corresponding to his order (delivery zone, amount of the order).

Shipping costs in mainland France are free for any order over € 60 including tax, weighing less than 3 kg and deliverable by colissimo 48h.

In all other cases the corresponding shipping costs must be selected and paid with the order.

If the customer fails to select the corresponding shipping costs, or if he chooses a category that does not correspond to the reality of his order, IZEULY reserves the right to postpone the delivery, or even to cancel the order altogether.

The shipping costs are likely to evolve in particular according to the evolution of the prices of the courier companies.

7. Payment

The price of the products is payable in cash on the day of the actual order. This price is indicated on the order confirmation sent to the customer by izeuly.

Payment can be made by

Credit card: Visa, EuroCard, MasterCard, CB

The Caisse CIC SP + secure payment system is used by the izeuly.com site.

The personal information that customers are required to communicate is perfectly protected and encrypted before transmission to the processing center.

A customer's order will not be considered effective until the payment center has given its consent. In the event of a refusal by SP + Caisse CIC, the order will be automatically canceled. IZEULY will notify the customer concerned by e-mail.

In the event of a flagrant inconsistency between the amount of the costs selected, and the delivery address or the weight of the package, the order will not be shipped.

Cash for amounts less than € 150 including tax:

In this case Izeuly will notify the customer when his order is ready, so that the latter can take delivery directly to the sales area during opening hours, or by appointment.

8. Promotions, discounts, loyalty

Izeuly may grant its customers discounts on all or part of the catalog.

Discounts are granted in relation to the displayed price (not crossed out). Thus, in the event of a crossed out price, the discounts apply to the price already discounted on the site. List prices are subject to change without notice, particularly in the event of an entry error.

Discount typologies:

• Discount granted to an individual: any person having accumulated a certain purchase amount including VAT on the izeuly.com site is likely to benefit for his subsequent purchases from gift vouchers, or from additional discounts valid on the entire site.

• Gift vouchers are deducted from the displayed price.

The data recorded by the izeuly computer system constitute proof of all transactions between IZEULY and its customers.

9. Return Products

The customer has 7 clear days from delivery (article L 121-16 of the consumer code) to return an article.

IZEULY undertakes to exchange the item or to grant a credit note, or to reimburse it for no particular reason, provided that it is returned unused and intact in its original packaging. The customer must be issued a duplicate of the "Return slip" by the carrier.

If the responsibility of IZEULY is not involved in the reason for the return (delivery in accordance with the order), the return costs will be borne by the customer and therefore deducted from the credit or refund or invoiced for an exchange. If the responsibility of {name_société} is involved (delivery different from the order), these costs will be borne by {name_society}.

Items returned incomplete, damaged or soiled by the customer are not accepted under any circumstances.

10. Liability

The products offered comply with current French legislation.

The photographs and texts reproduced and illustrating the products presented are not contractual. Consequently, the responsibility of IZEULY could not be engaged in the event of error in one of these photographs or one of these texts.

Izeuly cannot be held responsible for the non-performance of the contract concluded in the event of out of stock or unavailability of the product, in the event of force majeure, total or partial disruption or strike, in particular of postal services and means of transport and / or communications. , flood, fire, disaster.

Hypertext links may refer to sites other than the izeuly.com site. Izeuly disclaims all liability in the event that the content of these sites contravenes the legal and regulatory provisions in force.

IZEULY cannot be held responsible for damages of any kind that may result from improper use of the items delivered to the customer.

In any event, Izeuly's liability will be limited to the amount of the order.

11. Applicable law and disputes

This agreement is subject to French law. The language of this contract is French. In the event of a dispute over its interpretation and / or execution, the Aix en Provence Commercial Court will have sole jurisdiction.

The client and Izeuly will always favor an amicable solution before any legal action.

By virtue of articles 313-1 and following of the Penal Code, constitutes a swindle "the fact, either by the use of a false name or of a false capacity, or by the abuse of a true capacity, or by the use of fraudulent maneuvers, to deceive a natural or legal person and thus determine them, to their prejudice or to the prejudice of a third party, to hand over funds, securities or any good, to provide a service or to consent an act operating obligation or discharge ".

The offense of fraud by fraudulent use of a means of payment can give rise to a penalty of 5 years' imprisonment and a fine of € 400,000. The simple attempt is punished with the same penalties.
